It's official: Sandra Bullock wants out of her nearly five-year marriage to Jesse James.

"Yes, I have filed for divorce," the actress, 45, tells PEOPLE in the latest issue, in which she also reveals she has adopted a son, 3½-month-old Louis.

Bullock and husband Jesse James, 41, began the adoption process four years ago and brought Louis home in January but decided to keep the news to themselves until after the Oscars. Their close friends and family – including James's children Sunny, 6, Jesse Jr., 12, and Chandler, 15 – were essential in keeping the adoption a secret.

Then, just 10 days after the March 7 Oscars, Bullock and James separated following reports James had cheated. Bullock says she is now finalizing the adoption as a single parent.

A rep for Bullock confirms the star filed legal papers seeking to end her marriage, but declines to specify in what jurisdiction they are filed. Says Bullock of her decision to divorce: "I'm sad and I am scared."

It was a cheating scandal that rocked the couple's marriage, with several women claiming to have had illicit affairs with James.

As Bullock confirms her divorce, James reveals his feelings for the news:

"Sandy is the love of my life, but considering the pain and devastation I have caused her, it would be selfish to not let her go. Right now it is time for me to beat this addiction that has taken two of the things I love the most in life.

"I have always taken great pride in proving people wrong. That time has come once again to show that I am not what everyone says I am. I know in my heart that I can be the best father possible to my four children, and the mate Sandy deserves, and realize that this is an incredible mountain to climb. But I believe that the steps I have taken in the last 30 days are the foundation for making this happen. The lifelong commitment I am making is what being a real husband and father is all about.

"I ask that you please do not judge Sandy for the things I have done. She has done no wrong. She played no part in any of this. She has been an amazing wife, mother, and best friend, for the over 6 years we have been together."

Sandra Bullock: 'There Is No Sex Tape'

Sandra Bullock denied reports of husband (or soon to be ex-husband) Jesse James owning sex tapes with him and her to People Magazine lately.

"There is no sex tape," she says in a statement on Tuesday. "There never has been one and there never will be one."

James also denied a report saying he's in at least a dozen sex tapes with other women featuring Nazi-themed paraphernalia.

"The claims of sex tapes are untrue and completely fabricated," says James' rep in a statement to People Magazine.

Sandra Bullock's First Appearance

It has been two weeks since husband Jesse James' cheating incident exposed to the public. Bullock has been hiding but recently spotted outside of her garage, carrying shopping bags from Coach and Express. She done lots of online shopping from these stores and as the delivery came, paparazzi snapped some photos of her immediately.

Although no public announcement has made, at least we know Bullock is doing fine and willing to step out from her house. Her neighbors noticed several trucks appeared outside of her house lately, seems like she brought back many things from James' house.

As for James, he is in a rehab facility in Arizona. A member of the medical team told TMZ he is a patient there. It's also known that when James was stopped by a CHP officer, he told the officer he was going to Arizona to try to save his marriage to Bullock. But actually, he's just going to the rehab facility in Tucson.

Inside Sandra Bullock's Betrayal

n the wake of a scandal that has rocked her marriage, Sandra Bullock is quietly determining her next move, say friends.

Stunned by revelations that her husband Jesse James cheated with tattoo model Michelle McGee, Bullock "needs time to grieve and process what has happened," a close friend tells PEOPLE in its new cover story, on newsstands Friday.

The friend says Bullock, 45, learned of her husband's betrayal just eight days after her triumphant March 7 Oscar win.

"Her family was everything to her," adds the friend.

Another pal tells PEOPLE that while Bullock completely trusted James, 40, he could show another side of himself when she wasn’t with him. "Jesse is such a chameleon," says this pal.

According to a source close to James, the motorcycle mogul hopes to salvage his marriage and is currently focused on caring for his three children: Chandler, 15, Jesse Jr., 12, and Sunny, 6.

"He's trying to keep the lives of the children normal," says the James source.

After missing "The Blindside"s premier in UK, Sandra Bullock backs out again of her Oscar winning flick premier in Berlin, Germany. This is the second time that Bullock canceled her planned appearance after her husband Jesse James' cheating incident exposed. He had a 11 month long affair with tattoo model Michelle McGee--who was surprisingly used to be an Honors student in high school. Bullock has gone M.I.A from the public the past week and it was reported she already moved out from her house with James, planning to file divorce. In contrast to her silent actions, James stepped out and made a statement regarding to the incident:

"The vast majority of the allegations reported are untrue and unfounded.  Beyond that, I will not dignify these private matters with any further public comment.  There is only one person to blame for this whole situation, and that is me. It's because of my poor judgment that I deserve everything bad that is coming my way.  This has caused my wife and kids pain and embarrassment beyond comprehension and I am extremely saddened to have brought this on them. I am truly very sorry for the grief I have caused them.  I hope one day they can find it in their hearts to forgive me."
